Before BENCH, BILLINGS and JACKSON, JJ. *893 OPINION BILLINGS, Judge: Gwendolyn Frankle Young appeals from an order of the trial court denying her Rule 23B Petition for Post Conviction Relief. We affirm. FACTS In 1984, Young was convicted on charges of negligent homicide and driving under the influence. On direct appeal, we affirmed the trial court's judgment of conviction. Young v. State, 727 P.2d 1355 (Utah Ct.App.1986). In her petition, Young raised six issues, claiming, inter alia, that she had received ineffective assistance of counsel. The trial court concluded that her claims could have been presented on direct appeal and that she failed to show that she was without fault in not having raised them on direct appeal. The trial court denied the petition. Young's claims for post-conviction relief, as well as her motion for change of judge, were dismissed without a hearing. On appeal, Young asserts that the trial court erred in summarily dismissing her petition. She contends that she raised claims (a), (c), and (e) (the jury instructions in conjunction with her negligent homicide conviction) in her direct appeal. We disagree. "An appellant has the burden of showing error in the action taken by the trial court. No error of the trial court will be considered on appeal unless the complaining party first presents it to the trial court by an appropriate and timely motion." State v.
